Welcome to Hit the Town. These Terms of Service ("Terms") govern your use of the Hit the Town mobile application ("App") and related services provided by Hit the Town ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

Your interactions with third-party services, including any purchases, are solely between you and the third party.

Some links to third-party ticketing services may be affiliate links, meaning we may earn a commission if you make a purchase. This does not affect the price you pay.

The App uses your device's location services to provide nearby venue and event recommendations. Location data is used in accordance with our Privacy Policy. You can disable location services at any time through your device settings, though this may limit App functionality.

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, and software, are the property of Hit the Town or its licensors and are protected by copyright, trademark, and other intellectual property laws. Venue information, photos, and descriptions may be sourced from third-party data providers and remain the property of their respective owners.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY VENUE INFORMATION, EVENT DETAILS, OR RECOMMENDATIONS PROVIDED THROUGH THE APP.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIT THE TOWN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES RELATED TO VENUE VISITS, TICKET PURCHASES THROUGH THIRD-PARTY LINKS, OR RELIANCE ON INFORMATION PROVIDED THROUGH THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Hit the Town, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

We may terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time through the App settings.

We may update these Terms from time to time. We will notify you of material changes through the App or by other means. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Denver, Colorado.
